What hypothecation means on an Indian RC
When a bank or NBFC finances your car purchase, Indian motor vehicle law requires the lender's interest to be recorded on the vehicle's Registration Certificate. This entry appears in the RC book and in the Parivahan database under the lender's name. Hypothecation does not affect your day-to-day use of the vehicle — you drive it, insure it, and maintain it as normal. However, it signals to any buyer or another state's RTO that this car cannot be freely sold or transferred without clearing the charge first.
Is hypothecation the same as a lien?
For practical purposes, yes. Hypothecation is the specific Indian legal mechanism for moveable assets like vehicles under Rule 61 of the Central Motor Vehicles Rules. Both mean the lender has a registered claim on your car until the loan is fully repaid.
Why you must remove it after loan closure
